Theft of Confidential Information

Theft of confidential information in Florida is an area of law that includes both business records and customer information stolen from a company. Upon theft of confidential information, businesses may file lawsuits against accountable persons and entities under various State and Federal laws such as Florida’s  Uniform Trade Secret Act (“FUTSA”) for Misappropriation of Trade Secrets, Civil Theft, Conversion, Florida’s Combating Corporate Espionage Act, Economic Espionage Act and Defend Trade Secrets Act and Computer Fraud and Abuse Act.

How information could get stolen:
  • Having employees that are irresponsible with the data that they are in charge of and have a lack of understanding of the consequences that could occur.
  • Being careless with important data by storing it on a personal or unsecured computer.
  • There is weak security of the information system (and/or lack of security protocols in place) with passwords.
  • Not having a system that can track or flag usual login and data retrieved.
  • Not updating to the latest antivirus software and not tracking downloading of non-work related material such as games, movies, music, etc.
  • Not limiting access of your confidential information to only employees that need the information.

  • Former employee steals company information
  • Former vendor steals client lists and company methodology
  • Former employees steal business records and clientele files
  • Cybercriminals spreading viruses to cause a company to lose all it’s important information
