Florida Uniform Trade Secret Act

Misappropriations of Trade Secrets is a cause of action for the misuse of trade secrets by a third person. This cause of actions usually arises through the theft or misuse of a company’s trade secrets or confidential information by an employee or third party through improper means.

In Florida, we have the Florida Uniform Trade Secrets Act (“FUTSA”). In order to bring a claim for misappropriation of a trade secret, a party must be able to show that it has a trade secret or protected confidential information to protect. The party must also show that it took reasonable steps to protect the trade secret and confidential information. Finally, the party must be able to show that the trade secret and/or the confidential information was misappropriated by a third party without consent. A violation of FUTSA can provide relief in the form of money damages, injunctive relief and attorney fees and costs.
